Terms and conditions

1. Purpose

These conditions govern access to and use of TravelBrain (the "App" and this website, together the "Service"), operated by Paulino Villar Martínez (NIF/CIF 36147400W, Rúa Revolta, 2, 15999, Portosín). By creating an account or using the Service you accept these conditions.

2. Registration and account

  • You must be at least 16 years old to create an account and must provide truthful information when registering.
  • You are responsible for keeping your credentials confidential and for all activity carried out from your account.
  • You may request deletion of your account at any time from the app settings or by writing to us.

3. Description of the Service

TravelBrain allows you to plan trips: save places (manually, from the catalogue, or by sharing links, text and other content so that an artificial intelligence system can try to identify them) and organise them into trips with a map, routes, itinerary and indicative budget. Automatic place detection depends on the content and on whether its source platform allows access to it, so it is not guaranteed in all cases. Some advanced AI features and certain usage limits depend on the plan you have taken out — see plans and subscriptions.

The budget and estimates generated by the AI are indicative and may not match the actual prices of accommodation, transport or activities.

4. User-generated content

  • You retain ownership of the content you share or create on the Service (for example, your trips and notes), and you grant us the licence necessary to store it, process it and display it to you and, if you mark a trip as public, to other users.
  • If you mark a trip as public, other users will be able to view it and use it as a starting point (duplicate it) for their own trip.
  • You are responsible for not sharing unlawful content, content that infringes third-party rights, or content that breaches these conditions. We may remove content that breaches applicable regulations or these conditions.

5. Subscriptions, payments, renewal and withdrawal

5.1 Plans and prices. The Free plan is free of charge, with the limits described in plans and subscriptions. The Premium and Family plans are paid plans. The price of each plan is shown before you confirm the purchase and is the final amount you will pay each period.

5.2 Where you can subscribe. You can subscribe from the app on iOS (App Store) or Android (Google Play), or from the web version, with payment by card via Stripe. In addition to these conditions, the purchase is governed by the terms of the platform through which you subscribe.

5.3 Renewal. Subscriptions are monthly and renew automatically for the same period and at the same price, unless you cancel before the current period ends.

5.4 Cancellation. You can cancel at any time. If you subscribed via the website, do so in the My subscription section, using the Cancel subscription option: cancellation takes effect at the end of the paid period and you retain access until then. If you subscribed via iOS or Android, cancel it in the subscription settings of your Apple or Google account.

5.5 Right of withdrawal (subscriptions taken out on the website). If you subscribe as a consumer via the website, you may withdraw from the contract within 14 calendar days of subscribing, without needing to give any justification. To exercise this right, write to us at app@travelbrain.dev stating that you wish to withdraw from the contract and the email address of your account. We will refund the payments received, using the same payment method used, no later than 14 days after you inform us of your decision. If you requested that the service begin during the withdrawal period, you will pay the proportional part of the service already provided up to the time you inform us of your decision.

5.6 Purchases on the App Store and Google Play. Withdrawal from and refunds of purchases made in the stores are managed by Apple and Google in accordance with their own terms; you can request them from your store account.

5.7 Refunds outside withdrawal. Except in cases of withdrawal or non-conformity of the service, the period already begun is not refundable.

5.8 Legal guarantee. You retain the rights that the law grants to consumers regarding digital content and services. If the service does not work as contracted, write to us at app@travelbrain.dev and we will look for a solution.

5.9 Changes to prices and plans. We may modify the prices or features of the plans; we will notify you with reasonable advance notice of any change that affects you, and you will be able to cancel before it takes effect.

6. Intellectual property

The software, the TravelBrain brand, the design and the Service's own content (excluding user-generated content) belong to Paulino Villar Martínez or their licensors, and are protected by intellectual and industrial property regulations. No licence is granted over them other than that necessary for normal use of the Service.

7. Acceptable use

You must not use the Service to:

  • Breach the law, third-party rights or these conditions.
  • Attempt to gain unauthorised access to other users' systems, accounts or data.
  • Overload, attack or interfere with the operation of the Service.
  • Use the artificial intelligence features in an automated or abusive manner outside their intended normal use.

8. Limitation of liability

The Service is provided "as is". To the extent permitted by law, we do not guarantee that the Service will be free of errors or interruptions, nor the absolute accuracy of the itineraries, places or budgets generated by AI. Paulino Villar Martínez will not be liable for travel decisions (bookings, payments to third parties, etc.) made solely on the basis of information generated by the Service.

9. Suspension and termination

We may suspend or cancel your account if you breach these conditions or applicable regulations, notifying you whenever reasonably possible. You may unsubscribe at any time from the app settings.

10. Changes to these conditions

We may update these conditions to reflect legal or Service changes. We will publish the current version on this page together with the last update date; if the change is substantial, we will notify you through other reasonable means.

11. Governing law and jurisdiction

These conditions are governed by Spanish law. For any dispute, the parties shall submit to the courts and tribunals corresponding under the applicable consumer protection regulations.
